1. Acceptance

1.1 Information about how to enter and the prizes forms part of these Terms and Conditions. By submitting an entry, an entrant accepts these Terms and Conditions.

1.2 The Competition is a game of skill. Winners are determined by the judging and voting process set out in these Terms. Chance plays no part in determining any finalist or winner.

2. Eligibility

2.1 Entry is open to individuals who are Australian residents and aged 18 years or older at the time of entry.

2.2 Employees, officers, contractors and judges of the Promoter, and their immediate family members, are ineligible to enter.

2.3 Amateur and professional photographers may enter. Entrants must not be subject to any representation, distribution, licensing or other arrangement that conflicts, or may reasonably conflict, with FINEPRINTCO or the artist representation opportunity described in clause 10. Entrants may continue to sell their own work independently through self-managed channels.

2.4 Existing FINEPRINTCO represented artists are not eligible to enter. The Promoter may require reasonable evidence of eligibility.

3. Competition period

3.1 The Competition opens at 9:00 am AEST on Friday 4 September 2026 and closes at 11:59 pm AEST on Sunday 25 October 2026 (Competition Period). Entries received outside the Competition Period are ineligible.

3.2 The Promoter's systems and records are the official timekeeping device for the Competition.

4. How to enter

4.1 During the Competition Period, an eligible entrant must visit the Entry Page, complete the online form, upload one photograph and submit all mandatory declarations.

4.2 Entry is free. Each person may submit one entry and one photograph only. Joint entries are not accepted. An entry cannot be replaced or withdrawn after submission unless the Promoter approves a written withdrawal request in its discretion.

4.3 Incomplete, illegible, late, corrupted, misdirected or non-compliant entries may be disqualified. The Promoter is not responsible for entries not received due to technical or transmission failures.

4.4 No purchase, social-media account, follow, tag, share or public post is required to enter unless expressly stated on the Entry Page and incorporated into these Terms before the Competition opens.

5. Photograph requirements

5.1 The photograph must be the entrant's original work, must have been captured in Australia and must interpret the theme 'Australia Lifestyle'.

5.2 The initial submission must be JPG, JPEG or PNG, no larger than 20 MB, and at least 3,000 pixels on its longest edge. A resolution of 300 DPI is recommended. Portrait and landscape orientation, colour and black-and-white photographs are accepted.

5.3 Digital, mobile, film and drone photography are accepted. Film must be scanned or digitised as a high-resolution file. Drone photographs must have been captured lawfully and in compliance with all applicable aviation, access and privacy requirements.

5.4 Watermarks are not permitted. A signature is permitted only if it is an intentional part of the original artwork. Borders, frames or negative space may be included where intentional; accidental scan or export borders should be removed.

5.5 The entrant must retain the best available original and high-resolution master. A finalist may be required to provide a TIFF, PSD, RAW file or original high-resolution film scan within the time specified by the Promoter for authenticity and print-quality assessment.

6. Editing and artificial intelligence

6.1 The core photographic image must have been captured by the entrant. Images created wholly or substantially using generative artificial intelligence are ineligible.

6.2 Standard photographic adjustments and minor technical editing are permitted, including cropping, colour and exposure correction, contrast, sharpening, noise reduction and minor technical clean-up. Generative tools must not fabricate the core subject, add major elements that were not present, or materially misrepresent the captured scene.

6.3 The Promoter may request original files, edit history or other reasonable evidence. Failure to provide requested verification may result in disqualification.

7. Entrant warranties and releases

7.1 The entrant warrants that the entry is original, does not infringe copyright, moral rights, trade marks, privacy, publicity or other rights, has not been unlawfully captured, and is not defamatory, obscene, discriminatory, dangerous or otherwise unlawful.

7.2 The entrant must have all permissions, licences, location permissions, model releases and property releases reasonably necessary for the entry and the uses permitted under these Terms. For an identifiable child, the entrant must have written consent from the child's parent or legal guardian.

7.3 The entrant must provide copies of relevant releases or permissions promptly upon request. The Promoter may exclude sensitive cultural material, restricted locations or content where authority or respectful use cannot be verified.

8. Shortlisting and judging

8.1 The Promoter will review eligible entries and select 15 finalists using the judging criteria below. The finalists will be announced on Monday 2 November 2026.
• originality and creativity;
• composition and visual impact;
• technical execution;
• storytelling and emotional connection;
• interpretation of the Australia Lifestyle theme; and
• suitability for the FINEPRINTCO collection.

8.2 Each judging criterion will be given equal consideration. The Promoter may appoint or replace judges where reasonably necessary. Judges are not required to provide entrants with individual feedback, and correspondence regarding judging decisions will not be entered into.

9. Public voting and final result

9.1 Public voting opens at 9:00 am AEST on Monday 2 November 2026 and closes at 11:59 pm AEST on Sunday 29 November 2026. Only finalist photographs will be displayed for voting.

9.2 The final result will comprise 30% public voting and 70% judging-panel scoring. Each person may cast one vote. The Promoter may use email verification and other reasonable technical measures to identify duplicate, automated, fraudulent or manipulated voting. Any such votes may be removed without notice.

9.3 Entrants may share the official voting link and encourage genuine votes. Vote buying, automated voting, bots, multiple or false accounts, misleading claims, paid incentives, reciprocal-voting schemes or any other manipulation are prohibited. The Promoter may audit, invalidate or remove votes and disqualify an entrant where it reasonably suspects manipulation. The Promoter may disregard votes where it reasonably determines that the voting rules have been circumvented.

9.4 If scores are tied, the higher judging-panel score will prevail; if still tied, the higher combined score for originality and suitability for the FINEPRINTCO collection will prevail; if still tied, the judging panel will determine the result by applying the published criteria.

9.5 All decisions are final, subject to applicable law. The Promoter may correct an administrative, scoring or voting error that materially affects the result.

10. Prizes

10.1 The total cash prize pool is AUD $6,000: first place AUD $3,000; second place AUD $2,000; and third place AUD $1,000.

10.2 The first-place winner will also receive the opportunity to enter into an 18-month FINEPRINTCO Artist Representation Agreement. Representation is subject to the winner and FINEPRINTCO agreeing and signing a separate commercial agreement by 7 January 2027. Winning the Competition does not itself create an artist representation relationship.

10.3 Any works selected for representation, the scope and exclusivity of representation, artist royalty, retail pricing, production arrangements and other commercial terms will be discussed with the first-place winner after the Competition and recorded only in the separate Artist Representation Agreement. The artist retains copyright and moral rights.

10.4 Cash prizes will be paid by electronic bank transfer to an Australian bank account within 30 days after the winner's identity, eligibility and payment details are verified. Winners are responsible for any tax consequences. Prizes are not transferable or exchangeable, except as required by law.

11. Winner notification and verification

11.1 Winners will be announced on Monday 7 December 2026 on the Entry Page and/or FINEPRINTCO's social channels and will be contacted using the details supplied with the entry.

11.2 A provisional winner must respond within seven days and provide reasonable proof of identity, age, Australian residency, authorship, permissions and eligibility. If the provisional winner cannot be contacted, does not respond, fails verification or breaches these Terms, the Promoter may disqualify that person and select the next highest-ranked eligible entrant using the same process.

12. Copyright and competition licence

12.1 Entrants retain copyright and moral rights in their photographs. Entry does not transfer ownership to the Promoter.

12.2 By entering, each entrant grants the Promoter a non-exclusive, worldwide, royalty-free licence during the Competition and for 24 months after the winner announcement to reproduce, resize, crop for format, display, communicate and publish the photograph solely to administer, judge, publicise and report on this Competition across the Promoter's website, email, organic and paid social media, digital advertising, public relations and media materials.

12.3 The Promoter may add the Competition or FINEPRINTCO branding and accompanying text but must not materially alter the photograph. The Promoter will credit the entrant where reasonably practicable. The entrant consents, to the extent permitted by law, to the Promoter resizing, cropping for format, adding Competition or FINEPRINTCO branding and accompanying text, and omitting attribution where attribution is not reasonably practicable, solely for the purposes permitted under clause 12.2.

12.4 The Promoter must not manufacture, offer for sale or sell an entrant's photograph as a fine-art print without a separate written commercial agreement. The licence in clause 12.2 does not authorise merchandise or standalone commercial licensing unrelated to the Competition.

13. Publicity

13.1 Finalists and winners consent to the Promoter publishing their name or artist name, state or territory, photograph title, submitted biography or story, and photograph in connection with the Competition.

13.2 Winners agree to participate in reasonable remote publicity, such as an interview or supplied quote, without additional payment. No travel is required unless separately agreed in writing and paid for as agreed.

14. Marketing consent and privacy

14.1 By entering the Competition, entrants consent to receiving FINEPRINTCO email marketing about art, artists, products, offers and events. Entrants may withdraw their consent at any time using the unsubscribe facility provided in each marketing email. Unsubscribing will not affect an entrant’s eligibility or participation in the Competition.

14.2 The Promoter collects personal information to administer the Competition, verify eligibility, conduct judging and voting, award prizes, exercise the competition licence and, where consent has been given, send marketing. If required information is not provided, the Promoter may be unable to accept or administer the entry.

14.3 Information may be disclosed to service providers involved in entry hosting, voting, email delivery, judging, verification, professional advice, prize payment and publicity, and where required by law. The Promoter will not give entrant details to a sponsor for that sponsor's own marketing unless separate, express consent is obtained.

14.4 Personal information will be handled in accordance with FINEPRINTCO's Privacy Policy at https://fineprintco.com/policies/privacy-policy. Entrants may contact marketing@fineprintco.com about access, correction, privacy or marketing preferences.

15. Disqualification

15.1 The Promoter may, acting reasonably and to the extent permitted by law, disqualify an entrant or entry where the Promoter reasonably determines that the entrant has breached these Terms, provided materially false, misleading or fraudulent information, infringed or is reasonably suspected of infringing another person’s intellectual property, privacy or other legal rights, unlawfully interfered with or attempted to manipulate the Competition, judging or voting process, or engaged in fraud, misconduct or other conduct that materially compromises the fairness, integrity or lawful operation of the Competition.

15.2 Before disqualification for a matter capable of explanation, the Promoter may request information from the entrant. Nothing in these Terms limits any rights or remedies available at law.

16. Changes, suspension and cancellation

16.1 If the Competition cannot reasonably be conducted as planned because of fraud, technical failure, security incident, legal restriction, platform failure, force majeure or another event beyond the Promoter’s reasonable control, the Promoter may modify, suspend, extend or cancel the Competition to the extent reasonably necessary, subject to applicable law. Any material change will be published on the Entry Page.

16.2 The Promoter may replace a judge or adjust administrative dates where reasonably necessary. The Promoter will not materially reduce or withdraw an awarded cash prize except where permitted or required by law. Notwithstanding clause 10.2, the Promoter may withhold the Artist Representation Agreement opportunity where, acting reasonably and having regard to the published judging criteria, it determines that the winning entrant or their work does not meet the minimum artistic, technical, commercial or brand standards reasonably required for representation by FINEPRINTCO.

17. Liability

17.1 Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law.

17.2 Subject to clause 17.1, the Promoter is not liable for loss arising from an entrant's failure to comply with these Terms, unauthorised or unlawful content supplied by an entrant, or events outside the Promoter's reasonable control. The Promoter does not exclude liability to the extent it cannot legally do so.

18. Social platforms

18.1 The Competition is not sponsored, endorsed, administered by or associated with Instagram, Facebook, TikTok, Pinterest or any other social platform. Entrants release those platforms from claims relating to the Competition to the extent permitted by law and must comply with applicable platform rules.

19. General

19.1 If a provision is invalid or unenforceable, it will be read down or severed to the minimum extent necessary without affecting the remaining provisions.

19.2 A failure or delay by the Promoter to enforce a provision is not a waiver.

19.3 These Terms are governed by the laws of Queensland, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Queensland and courts entitled to hear appeals from them.
